# Terms

The esfis terms of use. We have written them to be understood and to be fair: they ask you for nothing we do not need and take nothing from you that is yours. They are still a binding agreement.

This is a translation. In the event of any discrepancy, the [Catalan version](https://www.esfis.com/condicions) prevails.

## Summary

This summary does not replace the full text, but it contradicts none of it:

- Your context is yours. We claim no rights over it, it never reaches us and we do not use it for anything.

- esfis is in early access: it may have bugs and it may change. Keep backups.

- The agents you open with esfis (Claude Code, Codex, Copilot, Grok and the rest) belong to their providers, under their own terms.

- No account is needed, and you can stop whenever you like: uninstall the app and, if you want, delete `~/.esfis`.

- If we change these terms in any material way, we will tell you beforehand.

## Acceptance

These terms govern the use of the esfis app for macOS, the `esfis` command line, the MCP server built into it and the `esfis.com` website. By installing or using the app, you accept them. If you do not agree with them, do not use it. Reading the website requires nothing beyond what the [privacy policy](https://www.esfis.com/en/privacy) says.

If you use esfis on behalf of a company or organisation, you represent that you may accept these terms on its behalf, and “you” refers to that organisation as well.

## Who we are

esfis is a project by [f.cat](https://f.cat), built in Barcelona, with an office on carrer de Pallars, in Poblenou. “We” means the owner of esfis. You can write to us at [esfis@f.cat](mailto:esfis@f.cat), and a person will answer.

## Definitions

- **App**: the esfis application for macOS, the command line, the MCP server and the updates we release for them.
- **Content**: everything you store or generate with esfis, such as items, instructions, spaces, policies, tasks and the `MEMORY.md`, `CLAUDE.md` or `AGENTS.md` files that come out of it.
- **Agents**: the third-party AI assistants and terminal tools you open or connect to esfis.
- **Consumer**: a person using esfis for purposes outside their trade, business, craft or profession.

## Early access

esfis is in early access and we give it out by invitation. We decide who we open it to and at what pace, and having asked for it does not entitle you to receive it. If we do give you access, it is for you: do not share the app or the download link with other people without asking us.

Because this is an early stage, esfis changes often. We may add, change or withdraw features, and some may fail. What we release is described in the [changelog](https://www.esfis.com/en/changelog). A feature announced as forthcoming is no commitment as to date or shape until it is actually available.

If esfis ever includes features that depend on our servers, or terms different from these, we will explain them beforehand, give you notice in good time and leave the decision to accept them to you. Nothing you already have installed will stop working locally because of it.

## Licence

For as long as you comply with these terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the app on your Macs, for personal and professional projects alike.

The app is licensed, not sold. You may not:

- redistribute, sell, rent or sublicense the app, including as part of another product;
- remove or alter its licence, ownership or trade mark notices;
- reverse engineer, decompile or disassemble it, except to the extent the law expressly allows;
- offer esfis as a service to third parties without a written agreement with us.

The app includes open source components, such as SwiftTerm. Those components are governed by their own licences, which prevail over these terms as far as they are concerned.

## Your content

**It is yours.** All the content you store in esfis is yours, and you keep every right in it. These terms grant us no licence over it, because we need none: the content lives on your Mac and never reaches us.

**We do not use it for anything.** We do not read it, analyse it, train models on it, sell it or pass it to anyone. If there is ever a feature that has to process it on our servers, it will not be switched on unless you decide so, and the content will be encrypted so that we cannot read it.

**You are responsible for it.** You represent that you have the right to store the content you put into esfis and to share it with the agents you connect, and that doing so infringes no third-party rights such as intellectual property, privacy or professional secrecy. If you store other people's personal data in it, your clients' for instance, you are the controller of that processing.

**You can take it with you at any time.** The content is a SQLite database and text files on your disk. There is no closed format and no export that depends on us.

## Your files and projects

esfis works with folders you choose, and does only what you ask of it there:

- it reads, without sending them anywhere, the logs the agents already leave on disk, such as `~/.claude/projects` or `~/.codex/sessions`, in order to show activity and usage and to import whatever memory you want;
- it writes `.esfis/feina.md` inside each project where you use tasks, and the `CLAUDE.md` or `AGENTS.md` files you compile into the folders you name.

The agents you open from esfis can read and change the files in your projects, exactly as they would outside esfis. Check what they do and what they push to your repositories: if a compiled file contains private context, it is for you to decide whether it belongs in `.gitignore`.

## Third-party agents and services

esfis opens the agents you already have installed and gives them the context your policies allow. If you use the Conversation tab, it sends text to the Anthropic API with your key. None of these services is ours:

- You use them under each provider's terms and policies, which you accepted directly with them.
- What a provider charges you for its service is between you and them.
- We are not responsible for what an agent or a model does with the context it receives, for what it answers, for the changes it makes to your files or for whether it is available.
- You decide, through the esfis policies, which context reaches each agent, and `esfis --why` tells you what each one received. Review them before you connect a new one.

We have no commercial relationship with these providers. Mentioning them does not mean they sponsor us or that we sponsor them.

## Acceptable use

You may not use esfis to:

- break the law or help anybody else break it;
- process other people's personal data without a legal basis;
- store or distribute child sexual abuse material, or content inciting violence or hatred;
- use the connected agents to attack systems or access accounts without permission.

Since the content never reaches us, we do not review it and we could not review it.

## Backups

The content lives only on your Mac, in `~/.esfis` and in your project folders, and we hold no copy of it. If the disk fails, you delete the folder or you lose the computer without a backup, the content is gone and we cannot recover it.

Context retrieval does the best it can, but it may fail to return a relevant item or return one that is not. Keep regular backups, with Time Machine for example, and do not use esfis as the single source of truth for critical decisions.

## Feedback and bugs

It helps us enormously to hear what is broken and what is missing. If you send us ideas or suggestions, we may use them to improve esfis, with no obligation towards you. This never applies to your content: if you attach a fragment to show us a bug, we will use it only to fix that bug and delete it afterwards.

If you find a vulnerability, write to us at [esfis@f.cat](mailto:esfis@f.cat) before making it public. We will reply, tell you what we are doing about it and, if you want, credit you for the find.

## Intellectual property

The app, the website, the documentation, the esfis name and the esfis logo are ours or our licensors'. These terms transfer none of those rights to you, beyond the licence to use described above.

You may use the esfis name and logo to talk about the product, with the [brand resources](https://www.esfis.com/en/brand), as long as it does not suggest a relationship with us that does not exist.

## Warranties

We undertake to make esfis work as we describe it in the [documentation](https://www.esfis.com/en/docs) and to fix the faults we know about within a reasonable time. Beyond that, and to the extent the law allows, the app is provided **as is**, with no further warranty that it is free of errors, that it will run uninterrupted or that the context it retrieves is accurate.

We do not warrant that esfis is compatible with every agent, macOS version or configuration, or that a third-party agent will keep working with esfis if its provider changes it.

**If you are a consumer**, nothing in this section limits the warranties the law gives you, in particular the conformity of digital content and services under the consolidated text of the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007).

## Liability

To the extent the law allows, we are not liable for:

- indirect damages, loss of profit or loss of opportunity;
- loss of content that a reasonable backup would have prevented;
- what the third-party agents and services you connect to esfis do, or the changes they make to your files;
- delays or failures caused by matters outside our reasonable control.

These limitations do not apply to damage caused by wilful misconduct or gross negligence, to damage to life, physical integrity or health, or to any liability the law does not allow to be limited. If you are a consumer, they do not affect the rights consumer law gives you and which you cannot waive.

## Ending it

**On your side.** You can stop using esfis whenever you like, without telling us: uninstall the app and, if you want, delete `~/.esfis`, the binary in `~/.esfis/bin` and the MCP configuration you added to your agents. Your content stays readable without esfis.

**On ours.** We may withdraw your licence if you breach these terms seriously or repeatedly, or if the law requires us to. Unless the law prevents us, we will tell you beforehand and explain why.

**If we stop making esfis.** We will give you notice in good time and will keep giving you a way to take all your content with you — it is already on your Mac. The app you have installed does not depend on us in order to run.

The sections on content, intellectual property, warranties, liability, governing law and general provisions survive after you stop using esfis.

## Changes

We may amend these terms to keep up with the product or the law. We will update the date at the top, and material changes will be announced in the [changelog](https://www.esfis.com/en/changelog) at least 30 days before they take effect, explaining what is changing and why. Changes that only fix errors, clarify the text or are required by law may take effect immediately.

If you disagree with a change, you can stop using esfis before it takes effect. No change will ever give us rights over the content you already have.

## Governing law

These terms are governed by Spanish law.

If you are a consumer, you may bring any dispute before the courts of your own domicile, and you keep the protection given to you by the mandatory rules of the European Union country you live in. You may also turn to the consumer services of your autonomous community, such as the Catalan Consumer Agency.

If you are not a consumer, the parties submit to the courts of Barcelona.

Before going anywhere, write to us: most problems are settled with an email.

## General provisions

- **Severability.** If a court declares a clause void, the rest remains in force.
- **No waiver.** Not exercising a right at a given moment does not mean we waive it.
- **Assignment.** We may assign these terms if esfis passes to another entity, provided it assumes all our obligations, the privacy policy included, and we tell you.
- **Entire agreement.** These terms and the [privacy policy](https://www.esfis.com/en/privacy) are the entire agreement between you and us about esfis.
- **Language.** These terms are written in Catalan. This English text is a translation, and where there is any discrepancy the [Catalan version](https://www.esfis.com/condicions) prevails, except where consumer law gives you the right to another language.
